The Landlord must pay the Tenant $1,548 for excess rent collected. The Tenant's allegations of harassment and substantial interference were dismissed.
Tenant filed an application alleging that the Landlord collected or retained money illegally by increasing the rent without proper notice, and that the Landlord harassed and substantially interfered with the Tenant's reasonable enjoyment of the rental unit.
Landlord demanded a $150/month rent increase and requested the Tenant pay a last month's rent deposit and utilities, after the tenancy had already commenced.
Tenant argued the rent increase was unlawful and filed an application within 12 months to challenge the validity of the rent increase.
Tenant paid $800/month rent instead of $650/month lawful rent from May 2022 to February 2023 due to Landlord's demand for rent increase without proper notice.
