The Board set aside the previous order and gave the tenant another chance to repay the arrears of $6,107 in monthly installments of $700 from May 2023 to December 2023, with a final payment of $507 due on January 1, 2024. The tenant must also pay the full monthly rent starting May 2023.
Tenant's current income and expected insurance settlement will allow him to repay the arrears
The landlord applied for an order to terminate the tenancy and evict the tenant due to the tenant's failure to meet a condition specified in a previous mediated settlement. The tenant filed a motion to set aside the order.
Landlord opposed the payment plan and asked that the motion to set aside be denied, arguing that the tenant is unable to afford the unit and has defaulted on three previous payment plans.
Tenant's car was stolen a year and a half ago and his unit was broken into, which set him back financially. Tenant is employed with Amazon and recently started back to work after a workplace injury. Tenant anticipates receiving an insurance settlement to repay the arrears.
