The Tenant's application is dismissed. The Landlord did not fail to abide by her obligations under s. 20(1) in connection with outdoor seasonal maintenance, as the parties had an arrangement where the Tenant was responsible for this.
Tenant applied for an order determining that Landlord failed to meet maintenance obligations under the Residential Tenancies Act, 2006 or failed to comply with health, safety, housing or maintenance standards.
Landlord advised Tenant several times that outdoor maintenance was not her responsibility.
Tenant argued these were maintenance obligations that should have been Landlord's responsibility.
Tenant notified Landlord on May 12, 2023 that she wanted Landlord to take over outdoor maintenance and reimburse her for expenses.
