The Landlord proved that the Tenants breached the consent order by not keeping their dogs on leash and under control. Eviction is the appropriate remedy, but it will be postponed until November 30, 2024 to allow the Tenants time to find alternative housing.
Tenants have been in the rental unit for a lengthy period of time, and there are a number of people living in the rental unit. It will be difficult for them to find an alternative rental unit for a reasonable budget.
Landlord applied for an order to terminate the tenancy and evict the Tenants because the Tenants did not meet a condition specified in the order issued by the LTB on March 13, 2024 with respect to keeping their dogs on a leash and under control.
Tenants claimed dogs are not violent, and that other tenant played with dogs before incident
Tenants kept dogs off leash, dogs attacked another tenant causing fractured ankle
Tenants continued to let dogs off leash after incident, showed no responsibility for dogs' behavior
