The tenancy is terminated effective May 31, 2023. The Landlord genuinely intends to move into the rental unit for the purpose of residential occupation. The Landlord has compensated the Tenant as required under the Act.
Landlord applied for an order to terminate the tenancy and evict the Tenant because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year.
Landlord testified that they recently had a baby and their partner moved in, and they want to use the rental unit as a single family dwelling.
Tenant argued the notice of termination was in retaliation for attempting to enforce their rights regarding the dog.
Tenant proposed fostering a dog, which the Landlord opposed.
