The Tenant's application is dismissed. The Landlord did not fail to meet their maintenance obligations under the Act or fail to comply with health, safety, housing or maintenance standards. The Landlord's pest control protocol was reasonable and the infestation was moderate, not serious.
Tenants applied for an order determining that the Landlord failed to meet their maintenance obligations under the Residential Tenancies Act, 2006 or failed to comply with health, safety, housing or maintenance standards due to a cockroach infestation in the rental unit.
Landlord informed Tenants that the building was treated every two weeks by their pest control company, and the next scheduled treatment was on November 18, 2022.
Tenants noticed 3-5 cockroaches in the unit in late October/early November 2022. The infestation worsened by November 7, with 10-15 cockroaches seen, including babies.
