The Landlords collected rent in excess of the amount allowed by the Residential Tenancies Act, 2006. The Tenant proved the allegations on a balance of probabilities, and the Landlords must pay the Tenant $2,036.80, which includes the excess rent collected and the cost of filing the application.
Tenant applied for an order determining that the Landlords collected or retained money illegally by increasing the rent above the maximum guideline increase.
Landlords sent a text message asking the Tenant to pay $1,800 per month due to their increased costs, stating 'in order to keep this unit, we hope you can accept the new rent as $1800 per month'.
Tenant agreed to the rent increase because he was afraid he would be evicted if he didn't.
