Application Date
Aug 2023
Hearing Date
Feb 2024
Order Date
Mar 25, 2024
The eviction portion of the Landlord's application is dismissed as the N4 notice was found to be invalid. However, the Tenant is ordered to pay the Landlord $13,236, which includes $13,050 in rent arrears and $186 in application filing fees. If the Tenant does not pay the full amount by April 5, 2024, they will start owing interest at 7% annually on the outstanding balance.
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Landlord served the Tenant with a valid N4 Notice, but the Tenant did not void the notice by paying the arrears. The Tenant was not present at the hearing.
Landlord served N4 notice by taping it to the rental unit door, which is not a valid method of service under the Act.
Tenant did not pay rent and was not present at the hearing.
