If the Tenant does not pay, they must vacate the unit by December 15, 2024. If the Tenant does not void the order, they must pay the Landlord $8,224.87 plus daily compensation.
Tenant's health circumstances
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit on the hearing date.
Landlord submitted that a lengthy payment plan would be inappropriate given this was the second application related to non-payment of rent within one year.
Tenant requested a repayment plan of $1,500 per month due to her current health and financial circumstances.
Tenant testified she was in an abusive relationship, which caused her to fall into rent arrears. She is now working and has savings to pay some of the arrears.
