The Landlord served the N12 notice in bad faith, the Tenant vacated as a result, and the Landlord did not move into the unit within a reasonable time. The Landlord is ordered to pay the Tenant $2,003, which includes $1,500 in general compensation and $450 for moving expenses.
Tenant brought a T5 Application claiming the Landlord gave them an N12 notice of termination in bad faith. The Tenant seeks expenses related to moving and storage, general compensation, and general damages.
Landlord entered into a 1-year lease on November 25, 2021, about 2 months before the Tenant vacated, and then sold the rental unit in March 2022, about a month after the Tenant vacated.
Tenant vacated the rental unit on January 30, 2022 after receiving the N12 notice.
