Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
The Tenant's Representative raised the issue of the validity of the N4 Notice, stating that the Tenant's unit was one of three units in the basement and therefore not properly identified. However, the N4 Notice, Certificate of Service and Application all noted the Tenant's rental unit as Unit B, and the Tenant's Representative provided no evidence to support that the unit should be identified differently. The tenancy will be terminated on May 19, 2024 unless the Tenant pays $12,186 to void the order and continue the tenancy. If the Tenant does not pay, they must vacate the unit by May 19, 2024 and pay the Landlord $8,694.67 plus $46.03 per day in compensation starting April 17, 2024.
