Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit on the hearing date.
The Tenant should have paid the rent arrears to void the N4 notice. The Landlord was entitled to the rent arrears up to the hearing date, the cost of filing the application, and compensation for the Tenant's continued occupation of the unit. The Landlord was also entitled to the rent deposit and interest on the deposit.
Tenant testified that he could pay $400 per month towards the arrears, was out of work for a significant period but is now back to work and makes $2,000 per month, and has approximately $10,000 in debt unrelated to the rental unit arrears.
The tenancy will be terminated on May 31, 2023 unless the Tenant pays $9,219.75 to void the order. If the Tenant does not pay, the Tenant must vacate the unit by May 31, 2023 and pay the Landlord $6,979.18, which includes rent arrears up to the hearing date and the cost of filing the application, minus the rent deposit and interest on the deposit.
