The tenancy will be terminated on April 30, 2023 unless the Tenant pays $37,479.50 by March 31, 2023 or $39,085.37 by April 30, 2023 to void the order. If the tenancy is terminated, the Tenant must pay $34,213.88 to the Landlord, which includes rent arrears and the application filing fee, minus the rent deposit and interest. The Tenant must also pay daily compensation of $52.80 for each day of occupation starting February 28, 2023 until the Tenant vacates.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant was still in possession of the rental unit on the hearing date.
Landlord's representative submitted that the Tenant has only made one payment towards rent in 2022 and does not believe the Tenant has the means to afford the unit.
Tenant acknowledged the arrears and proposed a payment plan to pay $10,000 within 3 weeks and $5,000 per month until the arrears are paid in full.
