Landlord applied for an order to terminate the tenancy and evict Tenant because the Tenant entered into an agreement to terminate the tenancy. The Tenant filed a motion to set aside the previous order.
The Landlord described how his family needs the full of the rental unit building to live in. The Landlord expressed concerns about the legality and safety of the rental unit and building.
The Tenant testified about his unsuccessful attempts to get the Landlord to agree to extend the date of termination to February 15, 2021.
The Tenant, who is a realtor, briefly explained the issues he has had in finding a new place to live. The Tenant's wife is expecting a child in January 2021, and the Tenant ended up buying a home with the builder called Mattamy Homes, which will close on February 15, 2021.
