The tenancy is terminated and the Tenants must move out of the rental unit on or before February 28, 2023. If the unit is not vacated by that date, the Landlord may file the order with the Court Enforcement Office (Sheriff) to enforce the eviction starting March 1, 2023.
Landlord applied for an order to terminate the tenancy and evict Tenants because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year.
Landlord was not opposed to granting a delay for the Tenants, but indicated they would like to have the property back for the new year to do renovations prior to moving in.
Landlord indicated they do not have mobility issues and submitted a doctor's note to support this. Landlord testified they intend to live in the unit for at least a year.
Tenants requested to stay in unit until their school was done, at least 6 months after the hearing date.
Tenants did not believe Landlord had genuine intent to occupy unit, citing Landlord's mobility issues and other reasons provided by Landlord's family members.
