The tenancy is terminated effective July 9, 2021. The Tenants must pay $24,828.63 to the Landlord, which includes rent arrears up to June 28, 2021 and the cost of filing the application, minus the rent deposit and interest on the deposit. The Tenants must also pay $59.20 per day for compensation for the use of the unit starting June 29, 2021 until they move out. If the Tenants wish to void the eviction order and continue the tenancy, they must pay $27,509.00 by June 30, 2021 or $29,349.15 by July 9, 2021.
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
Tenant Nazim Guliani explained that he has not made any payments to the Landlord for over a year because he had to pay for his daughter's wedding and had credit card debt. He stated that his income has been significantly impacted by the COVID-19 pandemic and that he will be fully vaccinated in September and will be in a better position to generate more income and pay the Landlord. He stated that he is unable to make any payments to the Landlord until September 2021.
