The tenancy will be terminated on October 31, 2022 unless the Tenant pays $3,093 to void the order and continue the tenancy. If the tenancy is terminated, the Tenant must pay $661.97 to the Landlord, which includes rent arrears and the application filing fee, minus the rent deposit and interest owed to the Tenant. The Tenant must also pay daily compensation for occupation of the unit starting September 28, 2022.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.
Tenant testified she has been unemployed since January 2022 and is receiving Ontario Works as her sole source of income. Tenant has three children, including a 29-year-old son with a 2-year-old daughter, living in the unit. Tenant stated she will not be able to afford rent on her own.
