File Number: TEL-19576-21
Hearing Date
Jan 2022
Order Date
Jan 26, 2022
Tenancy End Date
Feb 2022
The tenancy is terminated effective February 28, 2022. The Tenants must pay the Landlord $13,621.25, which includes rent arrears up to January 26, 2022 and the application filing fee, less the rent deposit and interest owed on the deposit. The Tenants must also pay $92.05 per day for compensation for use of the unit from January 27, 2022 until they move out. If the Tenants pay the full amount owing by February 28, 2022, they can void the eviction order and continue the tenancy.
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
Tenant Arthur James Sean testified that during the summer of 2021, his work vehicle, tools and equipment were stolen, which impacted his ability to work as a general contractor.
