The Landlords' application is dismissed as they failed to provide the required compensation to the Tenants by the termination date as per the Residential Tenancies Act, 2006.
Landlords applied for an order to terminate the tenancy and evict Tenants because the Landlord requires possession of the rental unit for the purpose of residential occupation. The Landlords also claimed compensation for each day the Tenants remained in the unit after the termination date.
The Landlords agreed that they did not cash the rent cheques and proposed at the hearing that the Tenant can accept one of those months as compensation.
The Landlords failed to provide the required compensation to the Tenants by the termination date as per the Residential Tenancies Act, 2006.
Tenant Starr Ellis testified that she had given the Landlord rent cheques for August and September 2021, but the Landlord had not cashed them.
