The Landlord's application is dismissed as the Tenant had already vacated the rental unit on September 14, 2021, before the Landlord filed their application on September 29, 2021. The Landlord is not prevented from pursuing a claim for rent arrears up to the date the Tenant vacated using a Form L10 application.
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. However, it was determined that the Tenant had already vacated the rental unit before the application was filed.
Landlord opposed the Tenant's request for adjournment. Landlord requested confirmation of the Tenant's oral evidence to determine if they could put the rental unit back on the market.
Landlord filed the L1 application after the Tenant had already vacated the rental unit.
Tenant sought an adjournment to obtain further legal counsel at the onset of the hearing.
Tenant testified that she moved out of the unit on September 14, 2021, and had abandoned any items remaining in the rental unit as of that date.
Tenant did not provide the Landlord with notice that she had left the rental unit.
