The Landlord's application for eviction of the Tenant is denied on the condition that the Tenant makes the following payments to the Landlord: $300 on June 20, 2021, $300 on the 20th of every month thereafter until September 20, 2024, and $286 on October 20, 2024. The Tenant shall also pay the Landlord the rent for the months of July 2021 up to and including October 2024 in full, on or before the first day of each corresponding month. If the Tenant fails to make any of the payments as required, the Landlord may apply for an order terminating the tenancy and evicting the Tenant.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant is still in possession of the rental unit.
Landlord's Agent explained that she attempted to negotiate a payment agreement with the Tenant, but they have not been able to agree on a payment schedule that would see the full arrears being paid within 2 years.
Tenant proposed a payment plan of $300 per month on the arrears, beginning on June 20, 2021. Tenant's representative indicated that he would assist the Tenant in re-applying for the rent subsidy as well as applying for rent assistance with the City of Ottawa.
Tenant's revenues consist of social assistance and the Canada child benefit payments she receives for her three children. She is currently expecting her fourth child and does not have anywhere else to live should she be evicted from her unit.
