Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit on the hearing date.
Landlords spoke to the tenants the week prior to the hearing, and the tenants were aware of the hearing date and time. Landlords attempted to arrange a repayment plan with the tenants, but the tenants consistently failed to follow through. One of the tenants had lost their job but had since found employment. The tenants have three children ranging in age from 8 to 17.
Tenants did not appear at the hearing to give evidence or dispute the landlord's application.
The tenancy will be terminated on September 24, 2023 unless the tenants pay $19,406 to void the order and continue the tenancy. If the tenancy is terminated, the tenants must pay $6,610 to the landlord, which includes rent arrears and the application filing fee, minus the rent deposit and interest.
