If the Tenants do not pay this amount, they must vacate the unit by October 31, 2022 and pay the Landlord $18,326.18, which includes rent arrears and the application filing fee, minus the rent deposit and interest.
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
Landlord objected to the payment plan and requested a standard order because this is not the Tenant's first application.
Tenants offered a payment plan of $1,500 extra on top of the monthly rent to stay in the rental unit due to the immigration file they have open with IRCC.
Tenants fell into arrears due to financial issues with the Canada Revenue Agency (CRA), and are currently in the process of sponsoring the Tenant's husband and have an immigration file open with IRCC.
