The tenancy will be terminated on December 31, 2023 unless the tenant pays $15,201.90 by November 30, 2023 or $17,439.48 by December 31, 2023 to void the order. If the tenant does not pay, they must vacate the unit by December 31, 2023 and owe the landlord $10,919.29 plus daily compensation.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant was still in possession of the rental unit on the hearing date.
Tenant stated she has been having issues using the landlord's app to pay rent and has attempted to pay using money orders in the past.
Tenant failed to provide written notice of issues and supporting evidence at least 7 days before the hearing as required by the Act.
