The Landlord's application is granted. The Tenants shall pay the Landlord $8,322.04 in rent arrears and application fee in monthly installments of $700 from May 2023 to March 2024, and continue paying the lawful monthly rent. If the Tenants fail to make any payment, the Landlord may apply for an order terminating the tenancy and evicting the Tenants.
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
Landlord sent a letter to Tenants on March 8, 2023 offering to propose an arrears repayment plan, but did not receive a response.
Tenant wanted to preserve the tenancy and proposed a payment plan.
Tenant's daughter moved out in November 2022, making it difficult for Tenant to pay rent. Tenant's daughter moved back in a week before the hearing, increasing Tenant's income.
