The motion to set aside the eviction order is denied. The stay of the eviction order is lifted immediately, and the order remains unchanged.
Landlord applied for an order to terminate the tenancy and evict Tenants due to Tenants giving notice to terminate the tenancy. The Tenants filed a motion to set aside the eviction order.
Landlord says Tenant AB was living with others who left, and she chose to leave because she could not pay rent on her own. Landlord denies telling Tenant AB she could change her mind about leaving.
Tenants argue eviction order should be set aside considering Tenant AB's disability, limited income, and inability to find alternative accommodation.
Tenant AB alleges Landlord told her verbally she could stay past termination date if her plans fell through. Tenant AB changed her mind about moving out on July 22, 2021 but could not reach Landlord.
