If the Tenant does not void the order, the Tenant must pay $7,781.68 to the Landlord and compensation of $19.73 per day starting January 17, 2023 until the Tenant moves out. The Tenant is given until March 31, 2023 to either void the order or find a new unit.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant was still in possession of the rental unit on the hearing date.
Tenant disputed the amount of rent arrears, claiming he owed the Landlord only $400 and had been paying rent in cash, but did not provide evidence to support this.
Tenant recently started a new job and wanted to leave the unit by the end of February.
