The tenancy is terminated effective October 30, 2021, the date the Tenant vacated the rental unit. The Tenant is ordered to pay the Landlord $2,881.26, which includes rent arrears, unpaid utility costs, and the application filing fee, minus the rent deposit. The Tenant shall make monthly payments of $50 until the balance is paid in full. If the Tenant fails to make any of the payments, the remaining balance will become immediately due with interest.
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent and substantial interference. The Landlord served a valid N4 Notice and the Tenant did not void the notice by paying the arrears.
Tenant argued the amount owed to them by the Landlord's son should be set off against the amount owing to the Landlord.
