The tenancy is terminated effective February 28, 2022. The Tenants must pay the Landlords $11,381.72, which includes rent arrears up to February 16, 2022 and the cost of filing the application, less the rent deposit. The Tenants must also pay $85.48 per day for compensation for use of the unit from February 17, 2022 until they move out. If the Tenants do not pay the full amount owing by February 28, 2022, the Landlords may file the order with the enforcement office to have the Tenants evicted. If the Tenants pay the full amount of $15,286 by February 28, 2022, the eviction order will be void and the Tenants can remain in the unit.
Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
Landlord indicated it would be prejudicial to extend any timeline for the Tenants to pay the arrears, and that the Landlord feels they are supporting both their own family and the Tenant's family due to the Tenants' failure to pay any rent.
Tenants requested more time to void the order for eviction to February 28, 2022.
Tenants indicated they have applied for financial support to cover the rent arrears, and that they are now back to work and receiving a childcare subsidy.
