Landlord applied for an order to terminate the tenancy and evict Tenants because the Landlord requires possession of the rental unit for the purpose of residential occupation for himself and his daughter.
The Landlord has met the requirements for terminating the tenancy under the N12 notice, including the 60-day notice period and the declaration of intent to occupy the unit. The Landlord's good faith intent to occupy the unit for personal use was established through the testimony of the Landlord's daughter. However, the Board exercised its discretion under section 83 of the Act to delay the eviction to March 31, 2022 to give the Tenants more time to find alternative housing.
