Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.
The Tenant has not paid the total rent the Tenant was required to pay for the period from March 1, 2021 to August 31, 2021. Because of the arrears, the Landlord served a Notice of Termination effective March 20, 2021. The Tenant is in possession of the rental unit. The lawful monthly rent is $1,122.45. The Landlord collected a rent deposit of $1,100.00 from the Tenant and this deposit is still being held by the Landlord. Interest on the rent deposit is owing to the Tenant for the period from August 6, 2020 to March 20, 2021. The Tenant paid $1,122.45 after the application was filed. The Tenant's Agent explained that the Tenant does not dispute the amount owed. She said that the Tenant was laid off from his work and that he and his children have had COVID-19. He got a severance from his work, however at the time of the hearing this amount was on hold in his account for approximately four to five business days. Once this amount is available, he will be able to pay his rent arrears. She also indicated that the Tenant has a new job where he earns approximately $3,000.00 per month after child support is deducted, so he has enough revenue to afford the rent going forward.
Landlord attempted to negotiate a repayment agreement with Tenant, but Tenant did not respond.

The tenancy is terminated effective October 18, 2021. The Tenant must pay the Landlord $5,931.82, which includes rent arrears up to October 7, 2021 and the cost of filing the application, less the rent deposit and interest on the deposit. The Tenant must also pay $36.90 per day for compensation for the use of the unit starting October 8, 2021 until the Tenant moves out. If the Tenant pays the full amount of $8,043.15 on or before October 18, 2021, the eviction order will be void and the Tenant can remain in the unit.
