The Landlord shall pay the Tenant a rent abatement of $5,760.00, which represents 40% of the monthly rent of $1,200.00 for 12 months. The Landlord shall also pay the Tenant $45.00 for the cost of filing the application. The total amount the Landlord owes the Tenant is $5,805.00, which must be paid by December 28, 2021.
Tenant filed a T6 Application for Maintenance with the Board due to a cockroach infestation in the rental unit. The Tenant claims the Landlord breached his maintenance obligations under the Residential Tenancies Act, 2006.
Landlord's Legal Representative argued that the Landlord began pest control treatments in October 2019 and that the situation does not warrant a 40% rent abatement.
Landlord recognized there were cockroaches in the unit and that other tenants told him about the presence of cockroaches. Landlord believes he has been responsive to these issues by hiring a professional pest control provider and providing the Tenant with borax and spray cans.
Tenant moved out on 2020-09-30 at the end of the tenancy.
