We estimate Application Date using rent arrears.
The tenancy will be terminated on October 31, 2023 unless the tenants pay $5,212.70 by September 30, 2023 or $6,756.00 by October 31, 2023 to void the order. If the tenancy is terminated, the tenants must pay $1,965.25 to the landlord, which includes rent arrears up to the hearing date and the cost of filing the application, minus the rent deposit and interest on the deposit.
The Tenants have resided in the rental unit for approximately five years, and the Tenant John Brown is currently experiencing issues with his health. The Tenants are currently unemployed and living on a fixed income.
Landlord applied for an order to terminate the tenancy and evict the Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
The Tenant who attended the hearing did not propose a concrete repayment plan, but requested additional time to pay the arrears and stated that she intends to borrow money from a friend to pay the Landlord in full.
