Landlords applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit on the hearing date.
Landlords' representative submitted Tenant has had ongoing issues with rent payment and this is Tenant's second or third time before the Board for non-payment.
Tenant testified she had mental health issues affecting ability to pay rent, but is confident she can make payments to pay arrears. Tenant expects to receive OSAP funding by mid-April 2025.
