The Landlord's application to terminate the tenancy and evict the Tenant for non-payment of rent was granted. The Tenant was ordered to pay $35,000 to the Landlord, which includes rent arrears up to the hearing date and the application filing fee. The Tenant was given until February 19, 2024 to either pay the full amount owing or vacate the unit.
Additional time given to the Tenant to either secure alternative accommodation or pay the outstanding amount.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit at the time of the hearing.
Tenant raised several issues under Section 82 of the Residential Tenancies Act, 2006 regarding heating, microwave, and illegal entry, but these were not found to be valid.
Tenant has not paid rent since August 2022.
