The Landlord has proven the grounds for termination of the tenancy and the claim for compensation. The tenancy is terminated effective August 31, 2024. The Tenants must pay the Landlord $9,941.40 in compensation for use of the unit from November 3, 2023 to March 7, 2024, and $78.90 per day starting March 8, 2024 until the Tenants move out. The Landlord owes the Tenants $2,519.54 for the rent deposit and interest.
The Tenants live in the unit with their two adult dependent children, and their son experienced a serious medical event. Forcing the Tenants to move would affect their son's schooling.
The Former Landlords and the Landlord have entered into an agreement of purchase and sale of the rental unit and the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation.
The Landlord testified that she had intended to move into the rental unit with her parents but not her boyfriend, and that her relationship with her boyfriend ended in December 2023.
The Landlord failed to disclose a previous N12 notice served on the Tenants.
The Landlord's previous N12 notice shows that the Landlord has acted in bad faith.
