The Landlord applied for an order to terminate the tenancy and evict the Tenants due to various issues, including damage to the rental unit, illegal acts, safety impairment, undue damage, and inconsistent use of the rental unit.
The Tenants were in possession of the rental unit on the date the application was filed. The Tenants vacated the rental unit on March 5, 2021, and the tenancy terminated on that date. The Landlord's application under Section 89 of the Residential Tenancies Act, 2006 was the only issue to be determined, as the remedies sought by the Landlord with respect to the N5, N6, N7, and N8 notices of termination were moot.
