The tenant had been in an accident and was recovering from surgeries, and expected an income tax refund to pay the arrears.
The landlord applied for an order to terminate the tenancy and evict the tenant due to non-payment of rent. The landlord served a valid N4 notice, and the tenant did not void the notice by paying the arrears.
The tenant testified that he had been in an accident in August 2022 which required follow-up surgeries, and that he had not been working but expected to be back soon. He said he was expecting an income tax refund to pay the arrears.
