The tenancy is terminated unless the Tenant pays $22,838.80 by April 30, 2023 to void the order. If the Tenant does not pay, they must vacate the unit by April 30, 2023 and pay $20,376.70 to the Landlord plus daily compensation of $79.85 from March 31, 2023 until move-out.
Landlords applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit at the time of the hearing.
Landlord testified the Tenant is not paying rent or water bills, and they have exhausted their credit line due to high arrears. The Landlord stopped calling the Tenant after September 2022 and has only been sending emails.
Tenant testified she has been working since November 2021 and has had some financial strain, but stopped paying rent in 2022. She is willing to pay $800 on top of half rent starting May 1, 2023 when she finds a roommate.
