The tenancy is terminated effective January 31, 2025. Tenants must pay $13,931.15 plus $60.82 per day from December 13, 2024 until they vacate. Eviction postponed to January 31, 2025 considering Tenants' circumstances.
Considering Tenants' health and financial status, a short postponement of eviction to January 31, 2025 is reasonable and not unfair to the Landlord.
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to meet conditions specified in a previous order issued by the Board on May 23, 2024. The Tenants did not pay the monthly rent and arrears as required by the previous order.
This tenancy is not financially viable for the Tenants, so it should be terminated no later than December 31, 2024.
Tenants have a total monthly income of $1,800 and monthly expenses of $2,600, so they want to move but need to retain tenancy until March 31, 2025 due to health issues.
Tenant Jegathesan Mangaikarasu testified that the order was only breached by one day, as they had to attend a funeral on September 25, 2024 and made the payments on September 26, 2024.
