The Landlord must pay the Tenants $5,587.89, which includes $324 for increased rent, $210.89 for moving expenses, and $5,000 for general compensation, as the Landlord served the N12 notice in bad faith.
Tenants applied for an order determining that the Landlord gave an N12 notice of termination in bad faith. The Landlord served the N12 notice to terminate the tenancy so he could move into the rental unit, but then re-rented the unit shortly after the Tenants vacated.
Landlord claimed his financial circumstances changed after the Tenants moved out, but the evidence showed he was already in financial difficulties before serving the N12 notice.
Tenants had to move to a smaller unit in an older building, and the new unit is an hour away from the previous rental unit. This negatively impacted the tenant's job and schoolwork.
