The tenancy terminated on February 19, 2024 pursuant to s. 91(1) of the Act. The Unauthorized Occupant shall move out by November 24, 2024 and pay the Landlord $4,794.40 for use of the unit from February 20, 2024 to November 5, 2024, and $18.44 per day from November 6, 2024 until they move out. The Landlord is also entitled to $201 for the application filing fee.
Landlord applied for an order to terminate the tenancy of Miriam Smart and evict Anne Michael, the unauthorized occupant, because the Tenant transferred occupancy of the rental unit to the Unauthorized Occupant without the Landlord's consent. The Landlord also applied for compensation by the Unauthorized Occupant for the use of the rental unit.
