The Landlord proved the grounds for termination of the tenancy. The Tenant was in possession of the rental unit on the date the application was filed. The Tenant was in possession of an illegal substance and engaged in an illegal act by using the bear spray, which resulted in harm to occupants in the rental unit. It would be unfair to grant the Tenant relief from eviction.
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to the Tenant committing an illegal act by using bear spray in the rental unit, which seriously impaired the safety of other occupants and tenants in the residential complex.
