Citation: The Corporation of the County of Wellington v Faubert, 2024 ONLTB 87337
File Number: LTB-L-040469-24
Hearing Date
Nov 2024
Order Date
Nov 29, 2024
Tenancy End Date
Jan 2025
The Landlord's application is granted. The tenancy is terminated effective January 3, 2025. The Tenant must pay the Landlord $4.77 per day in compensation starting December 1, 2024 until the Tenant vacates, and $186 for the application filing fee. If the Tenant does not pay the full amount by January 3, 2025, the Tenant will owe interest at 6% annually on the outstanding balance.
The Tenant is in rent geared to income housing and has very few options for alternate housing. His options are further limited by the fact that he has a dog, which he cannot part with because it is his deceased wife's dog, and it's all he has left of her.
The Landlord applied for an order to terminate the tenancy and evict the Tenant because the Tenant, another occupant of the rental unit or someone the Tenant permitted in the residential complex has substantially interfered with the reasonable enjoyment or lawful right, privilege or interest of the Landlord or another tenant.
The Tenant acknowledges that the allegations are generally accurate and that he did not stop the conduct or activity within seven days after receiving the N5 notice of termination.
