The tenancy is terminated effective October 31, 2024. The tenants must vacate the unit by this date and pay the landlord $15,929, which includes rent arrears, compensation for use of the unit, and application fees. The landlord is ordered to pay the tenant $300 for the key deposit. If the tenants do not vacate by October 31, 2024, the landlord may file the order with the Sheriff for enforcement.
Tenant has temporary place to stay and landlord requires unit for expanding family
Landlord applied to terminate the tenancy and evict the tenants due to persistent late payment of rent and the landlord's need to occupy the rental unit for their own use. The landlord served valid N4 and N12 notices, but the N8 notice was withdrawn.
Landlord testified that he is a father of a newborn baby and he and his wife intend to move into the rental unit as they need more space. Landlord offered tenant to live at an Airbnb paid by him and also offered her cash for keys.
N4 notice had inconsistencies regarding rent arrears period
Tenant testified that she had been trying to move out but due to high rent prices, she is unable to find a place. She also lost her job in February 2024 and has some medical issues.
