The motion to set aside the ex-parte order is granted. The Tenant shall pay the Landlord $13,983.13 in arrears and costs by December 1, 2023 and December 7, 2023, and then $500 per month starting January 1, 2024 until the arrears are paid. If the Tenant fails to make any of the payments, the Landlord may apply to the LTB to terminate the tenancy and evict the Tenant.

Landlord applied for an order to terminate the tenancy and evict the Tenant due to the Tenant's failure to meet a condition specified in a previous order issued by the Board on July 18, 2023. The Tenant filed a motion to set aside the ex-parte order issued on October 5, 2023.
Landlord argued that they held off on filing the L4 application until September 18, 2023, which provided the Tenant with sufficient time to make the arrears payment due on September 1, 2023.
Tenant's bank account was frozen for 14 days, preventing payment. Tenant has failed to pay rent for October and November 2023.
