The tenancy between the Landlord and the Tenants is terminated as of October 20, 2023, the date the Tenants moved out of the rental unit. The Tenants shall pay to the Landlord $15,220.68, which includes rent arrears owing up to the date the Tenant moved out of the rental unit and the cost of filing the application. The rent deposit and interest the Landlord owes on the rent deposit is deducted from the amount owing by the Tenants.
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had vacated the rental unit on October 20, 2023, prior to the hearing date.
Daniel Dimopoulos argued that he should not be a party to this application as he did not sign the lease agreement, and that the N11 and Compensation Agreement he signed were signed under duress.
Tenants vacated the rental unit on October 20, 2023, without paying full rent arrears.
