The tenancy is terminated unless the tenants pay $11,160 by January 31, 2024 or $12,288 by February 9, 2024 to void the order. If the tenants do not pay, they must vacate the unit by February 9, 2024 and pay the landlord $8,628.84 in rent arrears and application costs.
Considering the factors set out in Rule 21, I denied the adjournment request and proceeded with the hearing. In recognizing that the Tenants have resided in the unit since 2015, and that it is a family, I find it would not be unfair to postpone eviction for approximately one month to February 9, 2024, to provide them additional time to secure new accommodations.
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
Tenants have resided in the unit since 2015 and it is a family.
