The Tenant proved the allegations on a balance of probabilities, so the Landlord must pay the Tenant $2,381.00 as compensation for the N12 notice.
Tenants applied for an order determining that Landlords collected or retained money illegally. Landlords served N12 notice to terminate tenancy for personal use, but did not pay the required compensation to Tenants.
Landlord argued that the formal N12 notice was only served because the Tenants requested it, and that the parties had already mutually agreed to terminate the tenancy.
