Unless the Tenant voids the order, the tenancy will be terminated effective February 11, 2024. If the tenant does not void the order, the tenants are ordered to pay $25,152.04 to the landlord, which includes rent arrears up to the hearing date and the cost of filing the application, minus the rent deposit and interest on the deposit.
Tenant lives in the unit with partner and child and has lived in the unit since September 2021. Tenant's proposed payment plan is not affordable.
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
Landlord responded promptly to tenant's maintenance requests and provided evidence of pest control treatments. Landlord notified affected tenants about the car break-ins and advised them to contact police.
Tenant notified landlord about bed bugs and flooring issues, but stopped contacting landlord as he found the preparation for treatment burdensome. Tenant's car was broken into twice in the underground parking.
